Terms of Service for Snoretales

1. Acceptance of Terms

By accessing or using Snoretales, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

Snoretales is an AI-powered platform that allows users to create personalized bedtime stories and characters. The service utilizes artificial intelligence, specifically ChatGPT, to generate content.

3. User Accounts

You must create an account to use Snoretales. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. Please note that to prevent sign-up abuse, we do not allow account deletion.

4. Content Generation and Usage

4.1. Due to the nature of AI technology, Snoretales cannot guarantee specific results or outcomes for generated stories or characters. The content may vary and may not always meet user expectations.

4.2. Users are advised not to refresh the page while a story or image is being generated. Doing so may result in loss of credits without the ability to regenerate content.

4.3. Snoretales reserves the right to monitor, edit, or remove any content generated through our service that we determine to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable.

5. User-Generated Content and Character Creation

5.1. Users are responsible for the content they create, including characters and story elements.

5.2. Users are strictly prohibited from including specific personally identifiable information in their character creations or story inputs. This includes, but is not limited to:

• Social Security numbers
• Full legal names
• Complete addresses
• Phone numbers
• Email addresses
• Financial information
• Any other information that could be used to identify a specific individual in the real world

5.3. Characters should be fictional or generalized. If based on real individuals, they should be sufficiently altered to prevent identification of the actual person.

5.4. Snoretales reserves the right to remove or modify any user-generated content that violates these guidelines or poses a risk to individual privacy.

5.5. Users who repeatedly violate these guidelines may have their accounts suspended or terminated.

6. Intellectual Property

6.1. Users retain ownership of the characters they create, subject to the restrictions in Section 5. However, by using our service, you grant Snoretales a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content for the purpose of operating and improving the service.

6.2. The stories generated by Snoretales are the property of Snoretales. Users are granted a non-exclusive license to use these stories for personal or commercial purposes.

7. Payments and Refunds

7.1. Snoretales uses Stripe for payment processing. By making a purchase, you agree to Stripe's terms of service.

7.2. All purchases are final. Refunds are not provided for any reason unless reviewed by the support team (contact: [email protected]), including dissatisfaction with generated content or accidental loss of credits due to page refreshes during content generation.

7.3. Fees are payable in U.S. dollars or any other currency offered by our website. In cases where a story creation request could not be completed due to technical issues, such as problems with our API provider, we may provide credit reimbursement. 8. Limitation of Liability

Snoretales shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

9. Changes to Terms

Snoretales reserves the right to modify or replace these Terms at any time. It is your responsibility to check the Terms periodically for changes.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Governing Law and Arbitration

11.1. These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

11.2. Any dispute relating to your use of Snoretales's services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

11.3. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes.

11.4. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial.
